The Motion for Summary Judgment asks the judge to simply render a decision based on the facts presented in the documents already filed with the court. Other types of motions include: Motion for Summary JudgmentĪ Motion for Summary Judgment expresses to the court that there are no material facts in dispute, and so there is not need for a trial. Other pretrial motions can also be brought up at this time. This meeting of the parties is in place in order to settle minor issues and help the trial run smoothly. During a pretrial conference called by either party or the judge, a Motion to Dismiss can be presented. The Motion to Dismiss form is contains the information about the case and the reason that the defendant is asking for the case at hand to be dismissed. How to File a Motion to DismissĪ Motion to Dismiss is prepared through a Motion to Dismiss form. If the court grants the motion, the plaintiff cannot be granted relief on the matter. In any case, if the statute of limitations timeframe has expired, the plaintiff no longer has grounds to sue the defendant.įor example, if state law requires a plaintiff to bring a negligence case within two years of the date of the injury, and the plaintiff waits two years and two weeks, the defendant can file a Motion to Dismiss, asking the entire case be thrown out. The timeframes vary by the type of case, as well as by jurisdiction. In the event the defendant is not properly served, he or she can file a Motion to Dismiss based on insufficient service of process.Įach state has a statute of limitations, which is a set timeframe in which a plaintiff has to file a lawsuit. A sworn, written statement of when, where, and how the documents were delivered must be filed with the court. Personally delivering the lawsuit to the defendant ensures he or she has been notified of the lawsuit, and has an opportunity to provide an answer to the complaint. In most jurisdictions, service of process may also be accomplished by an individual over the age of majority, who is not involved in the case. This is referred to “ service of process,” and may be done by a registered process server, the sheriff’s department, or a Constable. Insufficient Service of ProcessĪccording to the law, a copy of the Summons and Complaint must be personally delivered to the defendant. Bob can file a Motion to Dismiss, as failing to greet another person is not illegal, therefore there is no claim for which relief can be granted. Joe files a lawsuit claiming that Bob failed to say hello in passing. For example, there is a company policy that employees greet one another in a friendly manner at work. In other words, if the complaint does not clearly say what the defendant did wrong, the court cannot grant any form of relief, and so the case does not need to be heard. If the plaintiff fails to provide sufficient facts to, if taken on face value as being true, indicate that the defendant violated a law, or caused harm or loss due to negligence, he has failed to state a claim for which relief can be granted. Failure to State a Claim for Which Relief Can be Granted Amanda must file a lawsuit in civil court for damages related to the crime. Amanda wants to sue Charlie for her financial losses, but the criminal court cannot hear that part of the case, as it is not the proper venue. Charlie is charged with the crime of embezzlement in criminal court. For example, Amanda’s accountant, Charlie, siphoned money out of her account for his personal use. The court, or “ venue,” in which the matter has been fined is the wrong court to hear the case. For example, if Bob is in a car accident in Florida, and the other party involved in the accident files a lawsuit in California, the court would not be able to hear the case. The court does not have the authority to rule on matters that affect one or all of the parties. For example, a suit requesting enforcement of a child support order cannot be heard in small claims court. The court in which the lawsuit was filed does not have jurisdiction, or the authority, to rule on the matter at hand. There are different reasons for filing a Motion to Dismiss, many of which revolve around the following legal deficiencies: Lack of Subject Matter Jurisdiction When a Motion to Dismiss is filed, information supporting the grounds for dismissal must be included in the motion. This is done when the defendant believes a claim in the lawsuit is legally invalid, or there are legitimate grounds for throwing the case out of court. Reasons for Filing a Motion to DismissĪ Motion to Dismiss is often filed with the court at the earliest stages of the lawsuit, typically before either party has conducted their discovery. A motion filed by either party in a lawsuit asking the court to throw out part of the case, or the case in its entirety.

"Even when you have a bigger system, a much thicker, stronger pipe system, it will still fail after 10 years or even after one year," he said. And that's because you have a dam, not because you don't have a dam," he told DW. "Not only in China, but also in America, you see that failed dams kill a huge amount of people. Yu says replacing the concrete infrastructure can end up saving lives. Instead of building fast-flowing water channels, sponge cities slow down the water in meandering streams without concrete walls and with room to spread out during heavy deluges. The basic principle of sponge cities is to give water enough room and time drain into the soil where it falls, rather than channeling it away as quickly as possible and sequestering it in huge dams. Rapid urbanization has made Chinese cities susceptible to flooding Image: EPA/STR/dpa/picture alliance The basic tenets After successful trials, cities are now obligated to build sponge city elements, with authorities hoping to turn 80% of urban areas into sponges by 2030. In 2013, Yu's ideas were adopted by the Chinese Central Government and the plan was rolled out to 30 cities. His ultimate vision is a city devoid of gray infrastructure, with wetlands, green areas, permeable surfaces, widespread vegetation, winding creeks, open areas next to roads, and floodplains. Yu says tropical cities were mistaken in implementing the same water-management systems that were developed in the mild climates of Europe, arguing they can lead to catastrophic damage. Floods there and in other developing countries, such as India and Bangladesh, have been blamed on rapid urbanization and the destruction of wetlands, which are natural sponges that trap and release water slowly. The issue was thrust into the spotlight when flooding swamped Beijing in 2012, crippling the city and killing scores of people. Permeable surfaces like this one allow water to seep into the ground Image: Mu Yu/Xinhua/picture alliance An adaptable solution He says the current approach of building vast concrete barriers and covering all permeable surfaces is doomed to fail and instead cities should adopt nature-based solutions to flooding. Kongjian Yu, dean of Peking University's College of Architecture, pioneered research into sponge cities, and has spent more than 20 years campaigning for their adoption in China. These concepts could be used in cities across the world to combat flooding, absorb carbon dioxide, increase animal and plant life, and expand green spaces. Instead of relying on the "gray infrastructure" of levees, pipes, dams and channels, sponge cities allow urban areas to absorb water in times of high rainfall and release it in times of drought. The ministry had ordered Hebei authorities to evacuate all residents in the flood detention area before it started to receive deluge, the ministry said, without disclosing how many people were involved in the urgent evacuation.Faced with worsening urban floods, cities in China are embracing nature and building what are termed "sponge cities." The use of Langouwa, which stretches for 228 square kilometers and can store 323 million cubic meters of water, will help relieve the flood control pressure in the Xiong'an New Area, as well as some water bodies in the downstream of Daqing, the Ministry of Water Resources said in a media release on Tuesday. The deluge is so severe in Tianjin, where Haihe is located, that local authorities raised emergency response for flood control from Level III to Level I, the highest in the country's four-tier emergency response mechanism, at 1 am on Tuesday.įlood control authorities in Hebei province also decided to lift the sluice gates for Langouwa flood detention area as increasing amount of flooding water flows into the Daqing River in the province. The commission decided to resort to these areas for flood storage as constant afflux of rainwater pour into water bodies in the basin in an accelerated manner, resulting in increasingly greater pressure on flood control work, the commission said on Tuesday. Ī batch of rarely used flood detention areas in northern China have been put into operation as downpours brought by Typhoon Doksuri swell many water bodies above their danger marks and triggered the highest level emergency response for flood control in some regions.Īs of 7 am on Tuesday, five flood detention areas in the Haihe River basin have been put into use, according to the Haihe River Water Conservancy Commission, the authority that oversees water resources management in the basin. Image Credit: ©Warner Bros/Everett Collection Bonus points to Siobhan Sweeney as the deadly-dry Sister Michael, beleaguered headmistress of the girls’ school, and Game of Thrones ’ Ian McElhinney as curmudgeonly Granda Joe. These are characters full of heart but devoid of sentimentality, as only people who’ve been getting on with their lives amid generations of conflict can be. Creator Lisa McGee wrote the show based on her own experiences growing up in Derry, which explains its earthy charm and gimlet-eyed nostalgia. D.F.Īgainst the backdrop of the Troubles in 1990s Northern Ireland, headstrong Erin (Saoirse-Monica Jackson), her kooky cousin Orla (Louisa Harland), uptight Clare (Nicola Coughlan), and party girl Michelle (Jamie-Lee O’Donnell) - plus her cousin, “wee English fella” James (Dylan Llewellyn) - stumble through teenage antics from burning down the local chip-shop owner’s flat to clogging the toilet at a funeral repast with weed-infused scones. By the time Dan pulled the plug after six seasons, he’d already given the world a modern TV classic - one that swept the comedy categories at last year’s Emmys. Catherine O’Hara’s Moira Rose is the diva to end all divas Annie Murphy’s Alexis completely updates the ditzy-socialite type for the 21 st century ( her theme song is priceless) and if eye-rolling were an Olympic sport, both the older and younger Levys would be gold medalists. What starts out as a fish-out-of-water comedy turns into an ode to community and kindness, and it’s to the credit of co-creators and co-stars Eugene and Dan Levy that the series finds the perfect balance between genuine sweetness and side-splitting snark. Having lost his fortune after being bled dry by a business manager, video-store mogul John Rose and his family find themselves relocating to Schitt’s Creek - a small backwoods town that John once bought for his son David as a joke. Then we considered not just how much these series made us laugh, but also how much they influenced the shows that followed, how well they reflected the world around them, and, on occasion, how deeply they made us feel emotions beyond mirth. Mostly, though, we were looking for a consistent group of characters and settings. This list is also composed entirely of English-language comedies, primarily American ones, with a handful of British and Canadian shows making the cut. Half-hour dramedies presented a blurrier picture we took those on a case-by-case basis, applying our own version of Supreme Court Justice Potter Stewart’s famous definition of obscenity: “I know it when I see it.” Where Enlightened and The Wonder Years seemed to fall just too far over the drama side of the line, for example, Atlanta and Better Things had enough comedy to qualify. Ditto comedy-drama hybrids that ran around an hour - Freaks and Geeks, say, or Crazy Ex-Girlfriend. Sketch comedies were out, from the explicit, like Saturday Night Live and The Muppet Show, to the more ambiguous, such as The Rocky and Bullwinkle Show. To choose the 100 greatest sitcoms ever, we first had to decide how to define the term. From Rob Petrie tripping over his ottoman on The Dick Van Dyke Show to Ilana face-planting on a Broad City subway car from The Honeymooners ’ Ralph Kramden barely containing his frustration with Ed Norton to Atlanta ’s Paper Boi doing the same with his cousin Earn from Lucy Ricardo getting drunk on Vitameatavegamin to Fleabag enjoying Gin in a Tin with the hot priest, the genre’s most beloved characters have been by our sides. For more than eight decades, the sitcom has both marked the times and provided a balm against them. Instead, there’s a tastefully placed Aer tag (not like the smart tracker). You don’t get a third ring on the opposite side to mirror it. Moving down along the shoulder straps, we find another D-ring on the right in addition to the earlier one above the water bottle pocket. Aer City Pack Pro | Magnets are neat, but we still miss simpler buckles. The tl dr is the City Pack Pro’s straps, while laden with thick padding, don’t feel cumbersome to move around in. Instead, there’s only fabric around that area that allows the shoulder straps to more freely flex and pivot according to the wearer’s posture.Ī more visible example of this would be the shoulder straps of the Bellroy Oslo, whose straps are attached to the bag by even thinner straps allowing it to move more freely. However, the portion just where the strap meets the top of the bag has a noticeable gap in the padding. The thickness feels uniform all throughout the straps, even towards the bottom. You get a pair of thick, densely-padded shoulder straps covered in mesh underneath. Aer City Pack Pro | No load lifters or waist straps here. Whereas the rest of the City Pack Pro more or less resembles its more travel-focused counterparts, its harness system is much more simplified. In case you’re scratching your head wondering where the major differences are between the City Pack Pro and the bigger Travel Packs, then a clearly visible sign would be in the harness system. We always keep a carabiner there that we can use to secure our bottle further using its handle or cap. Fortunately, there’s a D-ring above the pocket just waiting to be used as an anchor point. The key phrase there is “most of the time” since it can still happen under the right circumstances. Aer City Pack Pro | The water bottle pocket sits flush against the bag when unoccupied. Because the pocket’s also quite deep, it also has a firm grip on our bottle that’s enough to stop it from slipping out most of the time. Our 21-ounce Hydro Flask fits inside without a hitch. On the other hand, it also has a fair amount of stretch thanks to its gusseted fabric and an elastic built into the rim that’s only visible once you expand the pocket. It sits flush against the bag when it’s not occupied, keeping the City Pack Pro’s clean looks intact. On the opposite side, we find the water bottle pocket. That said, if you like carrying your backpack briefcase-style from time to time, you’re out of luck. To us, at least, this is a worthwhile trade-we’ll explain later. In lieu of a side handle is a secondary quick-grab pocket. The bad news is, despite being a good ten liters bigger than the City Pack, the City Pack Pro has one less handle. Aer City Pack Pro | The top handle feels beefy. Often we see daypacks that only have a folded-over nylon strap as a handle-or even lack a handle altogether-so we definitely appreciate it here. It’s super well-padded, making it comfortable to hold even for extended periods. Like the City Pack, the City Pack Pro also has a beefed-up top handle. You can also hang off accessories like keychains or a luggage tag if needed. It’s flanked by tabs that you can hold onto when zipping or unzipping the pocket. This alone is probably enough to make the City Pack Pro instantly recognizable as an Aer bag since even their small Slim Pouch has this. Look at it a bit closer, and you’ll find the usual marquee features.Īt the front is the AquaGuard YKK zipper track that runs across the middle of the bag. It has the squared-off, boxy appearance that’s all too familiar if you’re acquainted with their Travel Packs or even their limited-run Lunar Pack. The first thing to note about the City Pack Pro (or any Aer bag for that matter) is the styling. You could even make the argument that what makes the City Pack Pro stand out is how it blurs the line between daypack and travel backpack within Aer’s lineup. Forgoing the more daypack-like horseshoe-opening for a clamshell, the City Pack Pro behaves more like its bigger Travel Pack siblings. Despite being a daypack first and foremost, it’s still more than capable as a weekend travel backpack. While the City Pack Pro showcases improvements over the City Pack, it also has its fair share of unique features. Aer City Pack Pro | It’s the City Pack, but more pro. Fortunately, the City Pack Pro fixes that on two fronts by increasing capacity and having a more balanced approach to its layout. These pockets start bumping into each other, and you’re left with some untapped space in between. See, if you pack too many pockets and dividers into a relatively small main compartment, it ends up feeling too cramped. While impressive, we can’t quite make full use of it if we want to maximize its capacity. The Aer City Pack is a daypack that we note for its amount of organization fitted into a relatively small 14-liter package.
